By clicking "I have read and agree to the terms and conditions of this page”, I acknowledge the potentially hazardous nature of the physical exercise and rehabilitation courses (the “Succeed Courses”) provided by Smith Health Care LLC (“Smith Health Care”) and voluntarily assume the risk that my attendance or participation in the Succeed Courses may result in personal injury, permanent disability, and/or death. I understand that the risk of injury, permanent disability, and/or death may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Smith Health Care, its employees and independent contractors.

I agree to the requirements of this course: 

• You are safe to exercise
• Not using walker 
• Approximately 2- 3 months or more post knee replacement surgery 
• At least 90 degrees of knee bending
• You can stand up from a regular chair without using hands

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself including, but not limited to, personal injury, disability, death, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with attendance or participation in the Succeed Courses (the “Claims”). On my behalf (as well as my heirs, executors, successors and assigns), I hereby release, covenant not to sue, discharge, and hold harmless Smith Health Care, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Smith Health Care, its employees, agents, and representative, disability, and/or death occurs before, during, or after attendance or participation of any of the Succeed Courses provided by Smith Health Care.
